The Facts Are Key in DUI and DWAI Defense

I never take DUI charges at face value, and I will completely examine every aspect of your drunk driving case. I will determine whether the stop had probable cause. I will scrutinize the work of the officer who pulled you over. Did the officer follow proper training? Were the field tests administered correctly and in the correct order?

If a police officer has not been properly trained, if the tests were not administered according to the proper guidelines, or if the breathalyzer was not calibrated properly, you may have a strong defense. I have studied the teaching manuals for Colorado State Police officers regarding DUI stops and I can determine whether they have given the sobriety tests correctly.

The results of non-mechanical roadside tests are so consistently inaccurate that they may be completely inadmissible in court. I ensure that the guidelines for the road side observation tests are followed correctly.

If you have taken a breathalyzer, I can scientifically question the accuracy of the simulator alcohol solution used to calibrate the breathalyzer and I will determine whether the person administering the test was properly certified. If you are given a blood test, I will examin how the blood was drawn; what time the blood was drawn; whether the blood kit tests had the proper chemicals; and whether there was ever a break in the chain of custody of the blood sample. It is often beneficial to get the blood test readministered at another lab. I know that details matter, and a small detail can have a large impact on your case.

If I cannot get the District Attorney to drop the charges, or successfully win your case at trial, there are still significant benefits to hiring an experienced DUI lawyer such as myself. Additionally, I help can help you reduce your probation and alcohol monitoring.
